Lawyers in four US states have raised concerns that new Apple Watch features could breach eavesdropping laws, questioning whether turning conversations into AI-generated text requires everyone’s permission even when no playable audio recording is retained.
Why Are Lawyers Concerned?
The debate centres on Siri Recap, which creates AI summaries of conversations, and Live Rewind, which displays the previous 15 seconds of speech as text, both announced for Apple Watch Series 12 and Apple Watch Ultra 4. Attorneys in California, Massachusetts, Pennsylvania and Washington have questioned whether using these features without everyone’s permission could breach laws protecting conversations from unauthorised interception or recording.
These are concerns about how existing legislation might apply, rather than a court ruling that the watches are illegal. The legal position actually depends on the state, the circumstances of the conversation and how courts interpret what the technology does.
Apple argues that its approach protects privacy because users can’t access or share an audio recording, but the real point here is whether those protections answer the separate issue of permission to capture and process somebody else’s speech.
What Do The Features Actually Do?
Siri Recap creates brief summaries of conversations for the wearer to review later, potentially helping someone remember instructions or points raised during a discussion. Users can activate it manually or set schedules based on time and location.
Live Rewind serves a more immediate purpose, displaying the previous 15 seconds of speech as text when the wearer double-presses the Digital Crown. It could, for example, help someone recover a detail they missed without asking the speaker to repeat it.
Both features are due to arrive in beta later in 2026, initially in English and outside the EU, with a compatible Apple Intelligence-enabled iPhone required. Apple says that “Each Audio Intelligence feature is opt-in”, although that choice belongs to the wearer rather than everyone within listening range.
How Does Apple Protect The Information?
Apple says the watches use a protected hardware compartment called Secure Exclave to handle audio separately from the rest of the system. Apple says that “Audio Intelligence features don’t create audio recordings”, with raw audio inaccessible to the operating system, apps, the wearer and Apple.
However, that doesn’t mean conversations leave no information behind. Siri Recap generates summaries, while Live Rewind produces text snippets that users can save, and Apple says these are protected with end-to-end encryption when synced through iCloud.
The distinction matters because securing information and obtaining permission to collect it address different concerns. Encryption can restrict who reads a summary, but it can’t tell the other participants that their conversation is being processed or establish that they agreed.
Why Might No Recording Still Mean Interception?
Massachusetts legislation illustrates why the debate extends beyond whether an audio file exists. For example, its definition of interception includes “secretly hear, secretly record, or aid another to secretly hear or secretly record”, subject to the statute’s provisions concerning devices and prior authority.
The law also defines the contents of a communication broadly, covering information about its substance or meaning. That helps explain why a system producing text could raise questions even when it does not preserve speech for playback.
However, applying that wording to Apple’s particular design would require some legal interpretation. The other states have their own definitions and exceptions, so describing all four as having identical rules would oversimplify the issue.
Would Other People Know?
Live Rewind provides an audible chime even when the watch is on silent, together with a full-screen animation and microphone indicator. Siri Recap doesn’t provide an equivalent audible announcement while taking notes, leaving other people with less indication that their words may contribute to a summary.
Apple says Siri Recap is designed to exclude sensitive details such as financial information and government identifiers, and doesn’t identify speakers. Those measures could reduce what is retained, but they do not guarantee that a summary contains nothing confidential or that the wearer cannot recognise who said something.
What Does This Mean For Your Business?
For businesses, the immediate issue here is whether existing meeting and confidentiality policies cover automatic transcription and AI summaries as well as conventional recordings. A rule about switching off phone cameras may leave staff uncertain about a watch quietly processing a customer consultation or internal discussion. Clear guidance should explain when these features may be used, who needs to be informed and which conversations require them to be disabled.
Organisations should also decide where any resulting notes belong and who is responsible for checking them. A summary on an employee’s personal device may contain business information without being part of an approved record, while omitted context or an inaccurate paraphrase could create misunderstandings. Important decisions and commitments should therefore be confirmed through established channels rather than relying solely on an AI recap.
It’s worth noting that the US debate shouldn’t be treated as a statement of UK law, but it highlights a wider issue of trust. Useful memory and accessibility features can coexist with reasonable privacy expectations when their use is explained and agreed appropriately. Businesses will be better placed if they settle those expectations before an unnoticed summary becomes a complaint about confidentiality.
